Driver’s Intervention Program in Columbus and Delaware, Ohio

Certain portions of every DUI / OVI sentence are mandatory. These include a fine, license suspension, and jail sentence. There is an exception, however, for first time DUI / OVI offenders.

For a first DUI / OVI offense in Ohio that does not involve a high test (i.e., BAC of 0.17 or more), the minimum mandatory jail sentence is 3 days. However, a judge may permit the offender to attend a three-day driver’s intervention program in lieu of serving jail time.

For a first time DUI / OVI that does involve a high test, the minimum mandatory sentence is 6 days in jail. The judge may allow you to substitute 3 days in jail for the driver’s intervention program, but the remaining 3 days must be served in jail.

Repeat offenders cannot substitute a driver’s intervention program for a portion of their sentence. The jail sentence will be mandatory and the entire portion of the sentence must be served.

Driver intervention programs are typically held at a hotel and occur over a Friday, Saturday and Sunday. The average cost of participating in the program is $450. Presentations are given on a variety of topics, including alcohol, drugs and driving. In addition to these presentations, an assessment is generally conducted to determine if the person needs further alcohol or drug treatment.
